A 13-year-old schoolboy who raped his eight-year-old sister after watching hardcore porn on an Xbox has avoided a custodial sentence.
In a statement at court, the victim said she ‘felt sad’ at what had happened but wanted her brother to come home because she loved him and missed playing games with him.
Explaining the court’s decision, district judge James Prowse said he thought it ‘highly improbable’ the boy would repeat the offence and that detaining him would expose him to ‘hardened and sophisticated’ youth offenders.
Instead, the defendant will spend the next few months with social services in ‘intense’ sessions specifically tailored to deal with the offence.
After watching pornography with friends between March and May last year, the then 12-year-old ‘decided to try it out’ on his sister because she was small and ‘couldn’t remember stuff’.
The boy pleaded guilty to one count of rape, two counts of indecent assault and one count of inciting a child to engage in sexual activity.
Judge Prowse explained: ‘I think it is highly improbable that you will do anything like this again. You do not represent a danger to society.
‘You yourself realised what you had done. In your own words you felt disgusted with yourself.’
Defending the boy, solicitor Graeme Parkinson said he had no previous convictions and had shown no indication of offending.
‘I am sure with the appropriate help (the defendant) will grow up to be a very responsible member of the community,’ he said.
